Patent infringements continue while court sorts out details

Back in 2006, a court determined that Echostar was violating TiVo’s patents for certain DVR technology. The company was ordered to pay out damages but Echostar is still appealing the matter. TiVo recently asked the court to find Echostar in contempt for continuing to use the patent-infringing technology and also requested the court to order Echostar to pay $220 million in damages that have been incurred since the jury verdict has been on appeal. The judge took the matter under consideration and said that he hopes to have a decision by October 1st but may not have one until sometime much later this year.

Why does anyone buy TIVO??? Replay TV was way better and any computer can be a better DVR then TIVO.

WTF are they fighting over. It is a recording device using everyone elses hardware. We need judges in this country who understand technology so this crap stops happening.

I love how companies come up with damage claims....

I'd would be interesting to see the math behind how the Tivo lawyers figured the sum of $220 million in damages occurred while the verdict has been on appeal... especially since the Tivo lawyers even admitted that Dish changed their software to avoid infringing apon the patent.... so if the patent has NOT been infringed apon during this time, I wonder how they can claim damages.

My guess is they simply make them up.... with woulda, coulda, shoulda type arguments.

No prying required, just a simple software disable should be sufficient. Unless you roll your own DVR, you're at the mercy of your provider.

Dish SUCKS!

Dish is the company that sucks. Tivo invented DV recording for the masses and they should be revered for bringing something fresh to the consumer market.

Dish equipment is hard t install, difficult to use and way beyond the simple idea of watching TV.

I'm glad that tivo and DTV are talking again and making boxes. I still own two samsung 80-hour DTV/Tivos and they're teriffic!

Dish is dying and I will be the first to dance on their grave when they do (die).

It took my installer all of about 40 minutes to mount two antennas, trench cable, connect my DVR, and activate my box. Hardly difficult or beyond the simple idea of watching TV.

TiVo may have come up with a good idea once, but now their massive patent library is preventing anyone else from innovating in the field, since there's a good chance they'll inadvertently step on TiVo's toes in doing anything.

TIVO did not come up with the idea to record tv with a computer.
Computer users of the 80s and 90s did.

Also we were recording TV way before TIVO ripped off everyone elses ideas using VCRs and other devices. Whoever gave them a patent is an asshole.

Actually, I believe ReplayTV beat them to the market by about a month. Even still, I remember people using the very early ATI All In Wonder cards to record and "trick play" TV long before either Tivo or Replay.

Obviously someone that has not used a Dish DVR. Try using one or reading a review, they are very good units. Many have said they are the best out there.

It's ok for automakers, not for anyone else

I find it interesting that automakers routinely buy each other's cars, dissect them, and incorporate what they find into their own vehicles. They're free to copy the features of another maker as long as they find a different way to accomplish it. Did the first car with an electric throttle instead of a cable prevent others from adopting the same technique? Of course not.

That idea doesn't extend to the fuzzy realm of "idea patents." TiVo rolled out their product and that somehow precludes anyone else from offering a product that records to a hard drive, offers automatic recording of certain shows, or anything else their product did. Who would have thought of a "pause" function that resumed play when you un-paused!? At least Dish didn't include those stupid sound effects with each button press!

We don't have one brand of TV, computer, or automobile, so why are we being forced to have only TiVo? As long as they didn't steal the technology required to provide their features, Dish should be free to offer the same abilities in their product.

Why doesn't the first search engine have automatic "dibs" and outlaw every other search engine that came later? After all, they "invented" the idea of searching the WWW and anyone else's attempts still infringe on their idea even if not on their actual work.

Wow - amazing at the number of Tivo haters here.

When you compare the usability of a Tivo to any of the cable company DVR's, it is night and day. I've had DTV, Time Warner and Verizon FIOS DVR's and they are all crap. If you've ever compared any of them to Tivo, you would know.

The question is, do other DVRs suck because TiVo's patent portfolio prevents other companies from improving theirs, because they have to use complicated and less usable workarounds?

Then again, my guess is that at least Verizon's DVRs suck because of general incompetence on the part of Motorola, as I had similar issues with both a VZ DVR and a Comcast DVR that were both from Motorola (looked almost identical on the outside too)

I've had TiVo for many years - starting with a 20 hour SA TiVo bought with lifetime service in November of 2000 (still in use today), and graduating up to 3 DirecTV+TiVo combo units. I also use a Series3 HD CableCard unit regularly (bought one for my Mom).

TiVo's a great DVR, but with the exception of a couple glitches, I was just as happy with the Motorola 6416 from Comcast. Season passes? Check. Pausing/rewiding live TV? Check. Recordings being made reliably? Check. Dual tuners? Check. What else do I really need? Wishlists and suggestions are nice but not a necessity. TiVo costs way too much now. Lifteime is gone (or on special at a sky high price), and the monthly fees are sometimes more than what you'd pay to rent a DVR from your provider.

The impressive thing about TiVo is is that they got it right on the first try. The only critical thing missing in the originally released version was the ability to prioritize season passes. Everything else worked smoothly and consistently, just as it does today.

I hear you - yes the cable co DVR's usually have some of the same basic features, but in my opinion, Tivo implements those same feature much better. Mostly because the cable co DVR's are so slow and awkward to accomplish the same task.

Other things that set Tivo's apart and may not matter for many people are the ability to use "Tivo to Go" and download your recorded content onto a computer or mobile device for viewing away from your Tivo box. Also the ability to subscribe to webcast downloads, use web based movie PPV, multi-room viewing, web scheduling, photo/movie/music viewer for your own content, expandable recording capacity, etc. etc.

For me, the Tivo is much easier to use than the cable co DVR's and all the other benefits are a bonus.

I actually found my Motorola box faster than TiVo for the most part. You could press the "Day +/-" buttons to jump a full day foward and backward in the grid guide. Very handy for scheduling recordings around prime time. In general, the Comcast grid guide moved faster and with less delay. I could also re-order its season passes without that blasted "Please wait...". Ooh that was always my peeve with TiVo. The list of recordings came up instantly instead of after a long delay (they finally fixed this on TiVo when they added folders, but the fix was WAY WAY overdue).

Don't have much need for TiVoToGo. The broadband/HMO integrated functions might be interesting but I've always had a MediaCenter PC attached to my TV so I don't really need those either.

My Dish DVR is great - 2 guys installed it in less than 1 hour (including new install of the dish) - the program guide is 4,000 times better than TW's. Not seen Tivo - but I have no want to see it - the Dish DVR is great.
